The first meeting with a divorce attorney moves twice as fast — and costs half as much — when you walk in with the right documents already organized. Attorneys bill in six-minute increments. Every question they have to answer 'let me get back to you on that' is another billing cycle you're paying for.
This is the document list every dad should have gathered before the first paid meeting with an attorney. It's not the same as the full pre-filing checklist — that covers accounts, digital security, and kid-stability moves. This is specifically the paper you bring in a folder.
The five categories
The documents fall into five buckets. If you can get one from each category in the next 7 days, you have the foundation of a case:
- 01Income — your last three pay stubs, most recent W-2, and two most recent tax returns.
- 02Assets — recent statements for every bank account, brokerage, retirement account, and any property you own.
- 03Debts — credit card statements, student loans, auto loans, mortgages. Everything you owe.
- 04Marriage records — marriage certificate, prenup (if any), children's birth certificates.
- 05The other side — any pay stubs, tax returns, or account statements you already have legal access to for your spouse.

The five documents to lock down TONIGHT
Five documents matter more than any others in the first week. The free one-page checklist below names all five in order. Print it. Grab those five before you sleep. Everything else can wait a day.
How to organize before the meeting
Put every document in a single tabbed folder or binder. Label each tab with the category name. Include a one-page cover sheet listing what's inside and the date it was gathered. When the attorney asks 'do you have your last tax return?' you say 'yes, tab three,' and hand them the binder. That single move puts you in the top 10% of clients they see.
If you don't have legal access to a document
Stop and ask an attorney before you take any risky move. Do not log into your spouse's personal accounts. Do not photograph documents from her closed briefcase. Do not access her email even if you know the password. These moves get evidence thrown out AND make you look like the aggressor. There are legal ways to get every document you need — the attorney's job is to tell you how.
